Rental Registries are Nonsense. Asset Management for Property Managers.
Rental Registries are a Plague On Our Industry And Probably Unconstitutional
Do any of the cities where you manage rental properties require some type of “rental registration”?
Several in Central Ohio do. And one of them even charges a significant annual fee!
That’s on top of the long-standing county-level rental registration, which already exists and is enforced. Cities are pointlessly duplicating this registry in the name of ensuring “property values” and exterior appearance; meanwhile owner-occupied homes are some of the worst offenders and sit for decades with no code enforcement.
We need to start fighting back against this garbage. It’s kind of like the broken-windows theory, but applied to property rights: If we keep letting little nonsense like this pass unchallenged, more will follow and it will only get worse, as it has in many cities.
Today i have some good news to report from Uhrichsville, located in Northeast Ohio:
A rental property company sued the city in Tuscarawas County Common Pleas Court over the 2020 ordinance requiring landlords to register annually and pay a per-unit fee. The case went to trial before Judge Elizabeth Thomakos, who sided with the company, declaring the fee an illegal tax not being used exclusively for the benefit of landlords.
VICTORY!!!
